The company GOCARECC, SRL, which is duly constituted and organized in accordance with the laws of the Dominican Republic, with National Taxpayer Registry RNC No. 1-32-48021-1 and registered office at Fishing Lodge, Building D, No. 5054, Cap Cana, Verón-Punta Cana tourist municipal district, La Altagracia province, commercially known as WEMOVE, duly represented by its manager Mr. Nelson Rodríguez DA SILVA, of Spanish nationality, of legal age, holder of identity passport No. XDD356317, domiciled and resident in Cap Cana, who hereinafter in this document shall be referred to as THE OWNER;
By signing this form, THE CLIENT declares to recognize that GOCARECC, SRL is not responsible for irresponsible or improper use of the Golf carts covered by this contract. Consequently, THE CLIENT declares to recognize that GOCARECC, SRL and/or the WEMOVE brand shall not be liable for any damages that may be caused to their person during the use of the golf carts. Consequently, THE CLIENT releases GOCARECC, SRL and/or the WEMOVE brand, its shareholders, employees, executives, and related companies from any fact or circumstance that may arise during the execution of this contract and that could compromise the physical integrity of THE CLIENT. Likewise, THE CLIENT waives any type of legal action for damages and losses that their person could suffer from any incident or accident that might occur.
THE CLIENT recognizes and accepts that they are the only one legally responsible for this agreement and its object, acknowledging that the use of the golf cart vehicle by minors, driving the same under the influence of alcohol and/or consumption of prohibited substances is prohibited.
THE CLIENT agrees to use the seat belt provided in the golf cart at all times. Failure to comply with this provision exempts GOCARECC, SRL and/or the WEMOVE brand from any responsibility in the event of an accident.
THE CLIENT accepts that golf carts cannot be used outside the limits of Cap Cana. Any use outside this area will be considered a violation of the contract, and THE CLIENT will be responsible for any resulting damage or loss.
THE CLIENT recognizes and accepts that hotels located in Cap Cana reserve the right to regulate the use of golf carts within their facilities. This includes, but is not limited to, the designation of specific paths to travel and authorized parking for golf carts. THE CLIENT agrees to respect these regulations at all times.
THE CLIENT accepts that they are solely responsible for any accident that may occur while using the golf cart in Cap Cana and its facilities. The hotels located in Cap Cana and GOCARECC, SRL and/or the WEMOVE brand are exempt from any liability for accidents occurring during the use of the golf carts by THE CLIENT.
Therefore, the person signing below declares and recognizes the scope of this declaration, proceeding to sign it freely and voluntarily, certifying that it is the signature they usually use in all acts of their public and private life.
